Waste Removal Catford Terms and Conditions of Service

These Terms and Conditions set out the basis on which Waste Removal Catford provides waste and rubbish collection, clearance and related services to domestic and commercial customers. By making a booking, confirming an order, or allowing our operatives to begin work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business or organisation that requests or receives services from Waste Removal Catford.

Services means any waste removal, rubbish collection, clearance, loading, transportation, recycling, disposal, or related work carried out by or on behalf of Waste Removal Catford.

Waste means any items, materials, rubbish, junk, debris, furniture, appliances, garden waste, construction waste and any other substances that the Customer instructs us to remove, subject to applicable waste regulations.

Site means the premises, property or location from which waste is to be collected or where services are to be performed.

2. Scope of Services

Waste Removal Catford provides waste and rubbish collection services by prior arrangement. Services may include the collection, loading, transportation and lawful disposal or recycling of waste from homes, businesses, offices, rental properties, building sites and other locations within our operational service area.

The exact scope of services for each booking, including the type and approximate volume of waste, access details, and any special handling requirements, will be confirmed at the time of booking or during the on-site assessment. We reserve the right to decline work that falls outside our typical service capability or that breaches legal or safety requirements.

3. Booking Process

3.1 Bookings can be made by telephone, email, online form or any other contact method we make available. When making a booking, the Customer must provide accurate and complete information, including but not limited to:

a) Full name and contact details.

b) Service address and any access instructions.

c) Type, approximate quantity and condition of waste to be collected.

d) Preferred date and time window for the collection or clearance.

3.2 Any collection time provided is an estimate and is not guaranteed. We will make reasonable efforts to attend within the agreed time window but accept no liability for delays due to traffic, weather, accidents, operational issues or circumstances beyond our reasonable control.

3.3 At the time of booking, we may provide an estimated price based on the information supplied by the Customer. This estimate is not binding. The final price will be confirmed by our operatives on arrival at the Site once they have inspected the waste and assessed the work required.

3.4 The Customer or an authorised representative must be present at the Site at the start of the service to confirm the work, agree the final price and grant access. If no one is present, we may be unable to complete the service and a call-out or cancellation charge may apply.

4. Service Area and Access

4.1 Waste Removal Catford operates within a defined service area. Our ability to accept bookings may depend on the specific location and accessibility of the Site.

4.2 The Customer is responsible for ensuring that our vehicles and operatives have safe and reasonable access to the Site, including suitable parking, loading space, entry through gates, doors or communal areas, and any permissions required from neighbours, landlords or managing agents.

4.3 Where access is restricted, unsafe or significantly different from the information provided at booking, we may:

a) Charge additional fees to cover extra time, labour or equipment; or

b) Decline to carry out some or all of the services, in which case a call-out or cancellation fee may still be charged.

5. Pricing, Estimates and Quotes

5.1 Prices are generally based on the volume and type of waste, weight estimates, loading time, access conditions and disposal or recycling costs. Certain items, such as mattresses, refrigerators, electrical goods, tyres or hazardous materials, may incur additional charges due to specialist handling or disposal requirements.

5.2 Any price given prior to arrival is an estimate only, based on the details supplied by the Customer. The final price will be confirmed on Site after inspection of the waste. If the Customer chooses not to proceed after receiving the on-site price, we may charge a reasonable attendance or call-out fee to cover our costs.

5.3 All prices are quoted in pounds sterling and, unless expressly stated otherwise, are exclusive of any applicable taxes or charges imposed by law.

6. Payments

6.1 Payment is due in full on completion of the service, unless otherwise agreed in writing prior to the service date. We may require a deposit or full prepayment for certain bookings or larger jobs.

6.2 Payment methods accepted may include cash, debit or credit card, bank transfer or other methods we choose to offer. We reserve the right to refuse to commence or continue work if payment cannot be made in accordance with these terms.

6.3 For business or account customers with authorised credit terms, invoices must be paid in full within the period specified on the invoice. We reserve the right to charge interest and reasonable administration fees on overdue amounts, in line with applicable legislation.

6.4 Title to any waste removed passes to Waste Removal Catford when loading of the waste onto our vehicle commences, provided that payment is made in full. Until payment is received, we reserve the right to suspend services or retrieve waste where legally permissible.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving us notice by telephone or email. Cancellations or changes requested less than 24 hours before the scheduled service time may be subject to a cancellation fee, up to the full estimated service charge, to cover our costs.

7.2 If the Customer is not present at the Site at the agreed time, or access cannot be obtained, or the job cannot proceed due to circumstances within the Customer's control, this may be treated as a late cancellation and may incur a charge.

7.3 Waste Removal Catford may cancel or reschedule a booking if:

a) The Customer is in breach of these Terms and Conditions.

b) Access to the Site is unsafe or not as described.

c) Adverse weather, traffic, vehicle breakdowns, staffing issues or other events beyond our reasonable control prevent us from attending.

In such cases, we will aim to notify the Customer as soon as reasonably practicable and offer an alternative appointment where possible. We shall not be liable for any losses arising from such cancellation or delay.

8. Customer Responsibilities

8.1 The Customer is responsible for:

a) Providing accurate information at the time of booking.

b) Ensuring that the waste to be collected is clearly identified and separated, where needed, from items not intended for removal.

c) Obtaining all necessary permissions or consents to allow us to access the Site and remove waste.

d) Ensuring that nothing handed over for removal is of significant value or importance, including cash, confidential documents or personal possessions.

8.2 The Customer must not present for collection any waste that is hazardous, toxic, flammable, explosive, radioactive, clinical, medical, biological, asbestos-containing or otherwise subject to special handling requirements, unless we have explicitly agreed in writing in advance to collect such materials and the Customer complies with any additional conditions and charges.

8.3 The Customer warrants that the waste presented for collection is lawfully theirs to dispose of and that removal by Waste Removal Catford will not breach any legal, contractual or property rights of any third party.

9. Waste Regulations and Environmental Compliance

9.1 Waste Removal Catford operates in accordance with applicable waste management, environmental and transport regulations. We will use licensed facilities for the transfer, recycling and disposal of waste, aiming to divert materials from landfill where practical.

9.2 We may issue a waste transfer note or other documentation where required by law or requested by the Customer. The Customer must provide accurate information for such documents and retain copies where they are the waste producer or original holder.

9.3 Once waste has been loaded onto our vehicle and payment has been made, we assume responsibility for the waste and will handle it in compliance with relevant legislation. Prior to loading, the Customer remains responsible for the waste.

10. Liability and Limitations

10.1 Waste Removal Catford will exercise reasonable care and skill in providing the services. However, our liability to the Customer is limited as set out in this clause.

10.2 We shall not be liable for:

a) Any loss, damage or costs arising from inaccuracies in information supplied by the Customer.

b) Any loss or damage to items that the Customer intended to retain but did not clearly identify or separate from waste.

c) Minor or cosmetic damage to property that may arise from the normal course of removing bulky items where access is restricted, provided our operatives have taken reasonable care.

10.3 If any damage to property is caused directly by our negligence, the Customer must notify us in writing as soon as reasonably possible, and in any event within 7 days of the service. We shall have the right to inspect the damage and, at our discretion, arrange repair, replacement or compensation up to the value of the damaged item or property, subject to depreciation and fair wear and tear.

10.4 Our total liability to the Customer in respect of any claim arising out of or in connection with the services shall, to the fullest extent permitted by law, be limited to the total amount paid or payable by the Customer for the specific service giving rise to the claim.

10.5 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded.

11. Insurance

11.1 Waste Removal Catford maintains public liability insurance and any other insurance required by law for the nature of our services.

11.2 The existence of insurance does not extend or increase our liability beyond that set out in these Terms and Conditions or applicable law.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of the service, they should contact us as soon as possible with full details of the issue, including the service date and address.

12.2 We will investigate complaints in a fair and timely manner and may request further information, photographs or access to the Site. Where a complaint is upheld, we will seek to provide an appropriate remedy, which may include a partial refund, a repeat visit, or other resolution agreed with the Customer.

13. Data Protection and Privacy

13.1 Waste Removal Catford collects and processes personal data such as names, contact details, addresses and payment information for the purposes of managing bookings, providing services, processing payments and complying with legal obligations.

13.2 We will take reasonable steps to keep personal data secure and will not sell or share it with third parties except where necessary to deliver the services, process payments, recover debts, or comply with legal or regulatory requirements.

14. Amendments to Terms and Conditions

14.1 We reserve the right to amend these Terms and Conditions from time to time. The latest version will apply to all new bookings and services.

14.2 Where a change significantly affects existing bookings, we will use reasonable efforts to notify affected Customers. Continued use of our services after notification will constitute acceptance of the updated terms.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Waste Removal Catford.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by Waste Removal Catford to exercise any right or remedy under these Terms and Conditions shall be construed as a waiver of that right or remedy.

16.3 These Terms and Conditions constitute the entire agreement between the Customer and Waste Removal Catford in relation to the services and supersede any prior understandings, communications or representations, whether oral or written, relating to the subject matter.

16.4 The Customer may not assign or transfer their rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where necessary for the efficient delivery of services, provided this does not materially reduce the level of service received by the Customer.
